"The room is very small, probably only half the size of the West = Virginia=20 Supreme Court," Giatras said. Designed by Cass Gilbert, the same = architect who=20 designed West Virginia's Capitol and Supreme Court, the high court's = intimate=20 setting leaves lawyers virtually face to face with Chief Justice John = Roberts.=20

Monday's case, United States v. Hayes, concerned whether a 1994 = battery=20 conviction in which the victim was his wife barred Randy Hayes, a Marion = County=20 construction worker, from owning a gun.=20

In 1996, Congress enacted legislation making it illegal for people = who had=20 been convicted of misdemeanor domestic battery to own a gun. In 2004, = officers=20 responding to a 911 domestic violence call at Hayes' home found a = Winchester=20 rifle.=20

A federal grand jury indicted Hayes on charges of being a prohibited = person=20 in possession of a gun. Hayes entered a provisional plea of guilty, and = on=20 appeal the U.S. 4th Circuit Court of Appeals reversed his conviction.=20

The Department of Justice took the case to the Supreme Court, and in = March=20 the justices agreed to hear the case, making it one of roughly 75 cases = a year=20 to make the cut nationwide.=20

Although the case has become a part of the national debate on the 2nd = Amendment, Hayes never meant to become a standard bearer for gun rights, = said=20 Giatras, who has been practicing law since 1990.=20

"His one goal is that he'd like to go hunting again with his sons," = he said.=20 "He didn't set out to somehow change the world. Nobody did here. All we = were=20 trying to do was get [the case] reviewed for Randy, and we ended up in = the=20 Supreme Court."=20

Giatras enlisted the help of Michael F. Smith of the firm Butzel Long = to help=20 him prepare the written brief and for Monday's presentation.=20

"I chose Mike because of his honesty and sincerity, and he never had = an=20 intent or desire to argue the case," he said. "We were working = together."=20

Giatras said he plans to frame the quill pen memento given only to = lawyers=20 who appear in front of the Supreme Court.=20

After appearing before the highest court in the country, Giatras = indulged in=20 "a big steak" for lunch at local institution Charlie Palmer's = Steakhouse,=20 lingering over the meal with his family for the first time in a month.=20

Asked what he will take away from the experience, Giatras said it = reminded=20 him of the intensity and commitment needed for each and every client.=20

It also felt good to practice law on such an elevated stage, he said. =

Its not spelled out too well, but this is because a guy = who=20 violated the Lautenberg amendment. He was not convicted of domestic = battery, but=20 merely simple battery. President Bush's DOJ & Solicitor General = think that=20 is close enough.

You know = if push=20 came to shove and there was a draft, they'd take this guy, and if he = said he=20 can't have a gun, they'd give him one.

So, basically, there are two sets of laws. One for the government and = one for=20 us.

This is just liberal RINO=92s elitists, which pretty much the defalt = GOP, using=20 laws to weaken the citizenry at large.

You can be a felon and enter the military.

Only with a waiver. But the Lautenberg Amendment is not waiverable. = It makes=20 soldiers unable to carry a weapon and therefore non-deployable. The = military=20 does not and will not take people with a domestic violence conviction. =

At this time. Like I said, if push comes to shove. If WW = II, or=20 Korea, or Vietnam comes, they'll take what they can get. Further if the = law=20 changes, but the same act occurs, they'll take=92em. So, it's not so = much the=20 military, as is the ink scribble, on wood pulp, bound in leather on an = oak=20 shelf, presided by umba-gumba legal priest class.

Read the oral arguments. Interesting; largely hinges on crummy = wording of the=20 law, arguing over what was meant not quite being what was passed. Of = note, one=20 judge observed that the gov=92t=92s view requires adding word(s) to the = text, while=20 Mr. Hayes=92 view accepts the text as-is (with puzzling but not entirely = absurd=20 consequences). I=92m guessing Mr. Hayes will prevail on grounds of legal = vagueness: ultimately the law is what the law says, not what was = discussed in=20 committee.

The law is required to give the person notice of the activity = prohibited.=20 Citizens are not obligated to devine the intent of the law.

When was the appeal originally fired? If before = Heller, I=20 would think that should also be a basis for argument if this particular = appeal=20 fails. Prior to Heller, the Court had not clearly recognized the = RKBA as=20 an individual right. The effect of the Lautenberg Act was to deprive = certain=20 people of the RKBA on the basis of actions committed before its passage. = If the=20 RKBA is a fundamental right, then it cannot be taken without due = process. For=20 the legislature to void people's rights legislatively would constitute = either=20 ex-post-factor legislation or a bill of attainder. Both are explicitly=20 forbidden.

I know. What really bothers me is watching a Republican = administration=20 pursuing a blatantly antigun agenda. Trying to expand Lautenberg to = simple=20 battery???? Clinton didn=92t even do that. Why = are there=20 more federal prosecutors and ATF agents than anytime in our history? Why = did he=20 say he would renew the AWB if congress delivered it to him?
